REFUND & CANCELLATION POLICY

Effective Date: July 10, 2026
 

This Refund & Cancellation Policy ("Policy") governs all branding, website design, creative, consulting, and related services ("Services") provided by Marian Designed ("Marian Designed", "we", "our", or "us").

​

By engaging Marian Designed, accepting a quotation, remitting payment, or otherwise instructing us to commence the provision of Services, the Client acknowledges that they have read, understood, and agree to be legally bound by this Policy.

PROJECT CONFIRMATION

A project booking shall not be deemed confirmed until Marian Designed has received the required fifty percent (50%) non-refundable deposit of the total quoted project fee.

The deposit secures the Client's position within Marian Designed's production schedule and compensates Marian Designed for reserving production capacity, project administration, discovery, planning, scheduling, research, and all preparatory work undertaken prior to the commencement of design services.

Marian Designed reserves the right to decline, postpone, or cancel any booking where the required deposit has not been received.

NON-REFUNDABLE DEPOSIT

The Client expressly acknowledges and agrees that the initial fifty percent (50%) deposit is strictly non-refundable under all circumstances, including but not limited to:

​

  • cancellation by the Client;

  • change of business direction;

  • change of mind;

  • project postponement;

  • business closure;

  • inability to provide project materials;

  • dissatisfaction arising from subjective preferences;

  • or any circumstance beyond the reasonable control of Marian Designed.

  • ​

The deposit represents consideration for reserving production time and for work performed prior to the commencement of visual design.

FINAL PAYMENT

Unless otherwise agreed in writing, the remaining fifty percent (50%) of the total project fee shall become immediately due and payable upon completion of the Services or on the agreed project completion date, whichever occurs first.

Under no circumstances shall Marian Designed be obligated to release, transfer, publish, launch, or otherwise deliver any completed work until all outstanding invoices have been paid in full.

This includes, without limitation:

  • logo files;

  • brand identity assets;

  • source files;

  • website files;

  • website credentials;

  • hosting transfers;

  • domain transfers;

  • website launches;

  • style guides;

  • templates;

  • documentation; and

  • any other digital deliverables.

PAYMENT PLANS

Marian Designed may, at its sole discretion, offer payment plans for eligible projects.

Payment plans shall not exceed four (4) months, unless otherwise agreed in writing.

The existence of a payment plan shall not be construed as creating an ongoing support agreement, maintenance agreement, subscription service, or retainer arrangement.

Each installment shall become due on the agreed payment date regardless of:

​

  • project progress;

  • project completion;

  • delivery status;

  • launch date; or

  • the Client's use of the completed work.
     

Failure to make payments in accordance with the agreed payment schedule shall constitute a material breach of this Policy.

LATE PAYMENTS

All invoices are payable on or before the due date stated therein.

Any balance remaining unpaid five (5) calendar days after its due date shall incur a late payment charge equal to twenty percent (20%) of the total project fee.

Marian Designed reserves the right to:

​

  • suspend all Services immediately;

  • postpone project milestones;

  • refuse to release deliverables;

  • postpone website launch;

  • terminate the engagement; and

  • pursue recovery of all outstanding amounts permitted by applicable law.
     

Late payment charges shall accrue in addition to any outstanding balance and shall remain payable until discharged in full.

QUOTATIONS

All quotations are prepared on the basis of the information, project requirements, assumptions, and scope supplied by the Client.

Quotations remain valid for thirty (30) calendar days from the date of issue unless otherwise stated.

​

Following expiry of the quotation period, Marian Designed reserves the right to amend pricing without prior notice.

​

Any request by the Client that materially alters the agreed scope of work may result in revised pricing, additional fees, or the issuance of a new quotation.

SUSPENSION AND/OR TERMINATION

Marian Designed reserves the right to suspend or terminate the Services immediately where the Client:

​

  • fails to make payments when due;

  • repeatedly fails to provide requested information or approvals;

  • becomes unreasonably unresponsive;

  • materially breaches these Terms;

  • engages in abusive, threatening, discriminatory, or inappropriate conduct; or

  • otherwise prevents Marian Designed from performing the Services.
     

In such circumstances, Marian Designed shall not be liable for any resulting delays, losses, or damages.

CLIENT DELAY

The Client acknowledges that timely provision of content, approvals, feedback, imagery, and other requested materials is essential to the successful completion of the Services.

Where delays are attributable to the Client, Marian Designed reserves the right to revise project schedules accordingly.

 

Projects remaining inactive for more than ninety (90) calendar days due to Client inactivity may be deemed abandoned.

 

Marian Designed may require the Client to enter into a new agreement, accept revised pricing, or pay additional recommencement fees before work resumes

REFUNDS

Except where otherwise required by applicable law, Marian Designed shall not provide refunds for:

​

  • deposits;

  • design services;

  • strategy services;

  • consultation services;

  • website design;

  • website development;

  • branding;

  • creative direction;

  • digital products;

  • digital deliverables;

  • or any work already performed.
     

The Client acknowledges that all Services are bespoke and created specifically for the Client's business and therefore cannot be returned, reused, or resold.

THIRD-PARTY COSTS

The Client shall remain responsible for all approved third-party costs, including but not limited to:

​

  • website hosting;

  • domain registration;

  • software subscriptions;

  • premium fonts;

  • stock photography;

  • printing;

  • licensing fees; and

  • payment processing fees.
     

Such expenses are non-refundable once incurred.

CURRENCY

Unless otherwise agreed in writing, all quotations, invoices, project fees, installment payments, and additional charges are issued in United States Dollars (USD). The Client is responsible for any currency conversion fees, intermediary bank charges, wire transfer fees, or payment processing fees charged by their financial institution or payment provider.

GOVERNING LAW

This Policy shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

​

Any dispute arising from or relating to this Policy shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of the Philippines.

AMENDMENTS

Marian Designed reserves the right to amend, modify, or replace this Policy at any time without prior notice.

The version published on this website shall constitute the current and binding version.
